This action was instit uted by Mrs. Gil!hank to h ave h er r ights declared and Tyceman restrained from interfearing with her in th e ex ercise of those de:hts . Dingle.- The case for the plaint iff showed that in June 1883, T. ,J. Mc Murt ry was an agent in Bowmanville for the s ale of m achine1·y and arr:u1ged with the late W. 'f . D ingle, of Oshawa, to ac~ for him as agent in selling fanning mills. Dingle, against McMur try's wish, b~ought clown t o him 24 fanning mills and asked McMurt l'y to give him his promisory note for $552 to re p resent the mills to accommodate him, agree ing t hat all mills not sold were to b e taken back by Di ngle and allowed on the note as cash. l\foMurtry sold 11 out of the 24 au d accounted to Dingle for t he contract price o.f same, no.mcly $252, in t he fall of 1885. In the fall of 1886 the Dominion Bau k sued McM urtry on lha note which McMurtry had t o pay and brought ·.bis actio n against t h e Estate of Mr. Dingle to recover the amount h<.' so paid and co·ts. On the part of Mr. Dingle it was contended tha t the sale was a n o nt and out sale of 24 fannin ~; m ills for $552 which was settled for by the note refened to.
