Expansion receives 0MB a p Proval 'The Ontario Municipal Board ruled last week that both the Town of Whitby and Devon Entreprises "have acted in a responsible fashion" in the drawing up of plans to expand the K- Mart Plaza at the corner of Kendalwood Road and Dun- das Street. This bas effectively rejec- ted an appeal by area residents who were concer- ned about the location of a restaurant in the proposal. The plans submitted by the developer caîl for an ad- ditional 43,600 square feet of floor space to the exist-Ing facility and a new 6,000 square foot restaurant in the north-east corner of the plaza. Kendalwood Road residents were concerned about the restaurant that they claimed would cause odor, garbage and i. .)ise problems because of the late hours of operation. In its ruling, the 0MB said that the town had taken adequate measures to meet some of the residents' con- cerns. These corrective measureres included deflec- tors for the lighting, moving the' restaurant another 20 feet away from the nearest home, and the installation of landscaping to reduce traf- fic noise. "The board did not hear any specific evidence other than a series of generalized statements relating to the fear of witnesses as to the llklihood of these problems arising," the board said concerming the other matter raised by the residents.
