Ail new homes in Ontario are covered by the New Home Warranty Program (NHWP) administered by the Housing and Urban De- velopment Association of Canada (HUDAC). The warranties plan cov- ers, not only construction fiaws in your house, but aiso your deposit, made at the time of the offer to buy the house. The plan protects your down payment on a new house to a maximum of $20,000 and on a new con- dominium to any amount. To ensure that you have this protection, check that your builder is registered in the plan by asking for his registration num ber. Second, make sure your house has a warranty plan enroiment number. Ail new houses, whether it's a townhouse, semi-detached or condomin- ium must have its own num- ber. Third, when you make an offer, to purchase the house and a down payment, mnake sure you get a NHWP receipt. If you do ail these things you'Il be assured of having the warranty plan coverage. Under the warranty plan, the builder undertakes to repair any defects in mate-. riais or workmanship during the first year after you take possession at no cost to you. If there is a probiem with your house you can expect the builder to take remediai action quickiy. If the builder doesn't live up to his obligations the NHWP wiii act as a mediator in the dispute. To begin this procedure just write a letter to your builder, listing your complaints, and send a copy to your nearest NHWP of- fice. hI most cases, the NHWP officiais are able to persuade the builder to take corrective action. If the builder stili refuses to act, you can ask the NHWP to step in offi- ciaiiy by sending them $50 (which is refunded if your compiaint is justified) and the NHWP wiil send an in- spector to look at your house. The conciliator wili make a decision within 14 days as to what repairs are the buiider's responsibility. After the first year, the NHWP covers the cost of re- pairing major structurai fiaws up to a maximum of $ 20,000 for four years. Defects af ter the first year should be reported to the NHWP, flot the builder. With new condominiumls, two sets of warranties are given under the warranties plan. The first goes to the individuai unit owner while the other goes to the condo- minium board of directors covering defects in the "ecommon areas" of the de- veiopment.
