By Mike Kowalski The Town of Whitby will seek reimbursement of any costs in- curred in fighting a local develo- per's 'frivolous' challenge of a zoningbylaw. Town ceuncil last week voted te ask the Ontario Municipal Board (0MB) te, disrniss an appeal filed by The Nicols Group of Oshawa. In addition, the municipality wilI ask the 0MB te, award costs should the mattor go te a hear- ing and the board~ rule in the Town's favour. The bylaw, which doals with perrnitted uses within agnicul- tural and greeribelt areas, was approved by council last July.th Th ios Group appealedth bylaw on the grounds that it will part of .FE D don't th*ey urderstanid? Vote for accountaàbility! fRDRSON Iepenrt yaWMques by,Offil, gn p revent the company frorn deve- lping land it ewns on the north- east corner of Lakeridge Ilead and Highway 2. Various proposaIs, the most recent a' gas station, have been put forward over the years by the cernpany and previous ownors. Ali were rejected by council and, in least one case, the 0MB as woll. According te a recent letter from, the company, the latest proposal calîs for a «multi-million dollar" amusement contre and golf course. "A project such as this would bring well-needed business taxes, property taxes, and revenue dol- aste Witby, as well as creat- ing an attraction that would have been noted nationwide," the letter st.ates. An officiaI freni The Nicols Group was net immediately available for comment. However, councillor Ross Bat- ton teld The Free Press that ne development will be permitted on the site until various issues are resolved, among thern the final route for tho freeway link bet- ween Hfighway 401 and the future Hignway 407. (Whitby wants the route te, follew LakeridgeRead, whoreas the Ontario Minisr of Trans- portation wants it built further east between Halls and Corona- tien roada.) The Nicols' property is desig- nated'epen spaoe in Durham Region's proposed officiai plan, while ne decision has been made in Whitby's plan sinco that docu- ment is currently being updated. «We have ne idea what will happen wvith the land use,» said Batten, chair of ceuncil's 'plan- ning an developrnent commnittee. "I-t's ne t that we don't want te, ive hirn an answer, we have, but apparently hie doesn't like it. Batten said The Nicels Group is net the enly landewner in the area whese property is in limbe. «He's net the only ene who would like an answer, but hie wen't put it inte perspective. He cannot understand that his pro- perty is in the middle of this discussion.» By asking the beard te, award cests, "We're saying this is net something the 0MB should be dealing with and that eur tax- payers should net have te pay te de fend,» Batten added. Although the original recom- mendation was only te ask the beard te dismiss the appeal, ceuncillor Don Mitchell wanted it amended te seek costs. Councillor Dennis Fox, hewe- ver was leery of such a move. uI appreciate the reason fer it but my fear is that we rnight be about te, embark on something that might change eur whole appreach te planning and the character ef t he tewn and coun- cil,» said Fox. «We've always feit that rosi- dents had the right te, make objections te, the beard,» ho said. (The 0MB is a provincially- appointed body which rules on muncial disputes. Only the cabinet can 'reverse a board rul- ina.) fo'x was worried that the pub- lic may misunderstand council's reasons for seeking costs. "I don't want -te discourage geele who have honest concerris ut are afraid te cerne forward for fear their objections might be deemed frivolous and it will cost them xnoney,» lho said. «I don't ever want us te, appear te,. look confrontational," Fox' added. Councillor Joe Drumm, who ha puhed for a uniformi policy o f seekng costs when peeple «abuse the system», supported the amendment. «Unless I had a hole -in my head, I would nover seek costs frorn the board unless it is the epinion of our staff that it (appeal) was frivolous,» said Drumm. "If we continue te go te the board on appeals and it costs us thirty te forty te fifty thousand (dollars) for a hoaring, I have ne objection if it's frivolous.» OnI y councillor Marcel Brunelle joined Fox in voting against Mitchell's amendnient.
