"We're very close," said Mark Frayne, solicitor for, Whitby businessman Art Robinson, owner of the Prince Edward Island ferry. "Fin sure once. sometbing han- pens the presa releases will b flyin» said Frayne. diAtewoug, lie would not in- dicte . atorwbo, is holding up the deal, Frayne did say the three-cornered agreement is a «complicated" one. ultas a matter of making sure everyone's happy with.i, said Frayne. Two months ago,, the Onitario cabinet passed ar. order-in-coun- cil *absolving Whitby Hydro of any liability fur the 76-year-old vessel'sPCBs. The province will take ful responsibility if an accident in- volving the PCBs occurs wbile the cemical is on Hydro's pro- pTe province will also absolve HIydro of any expenses involved in moving and storing the POBs sbouldRobin son default on bis part of the tripartite agreemnent. These bad been p rime con- cerns of the Whitby Hydro Elec- fric Commission when it agreed to. accept the PCBs earlier this year. POBs (polycblorinated .bipbenyls) are a man-made che- mical used in some ouas. Production of PCBs was ban- ried in the 1970s after it was linked to cancer in laboratory animais. Two transformera on-the ferry are filled with pure POBs. A third transformer contains minerai. ou with- low-level PCB contamination, slightly above the acceptable standard of 50 parts per million. In addition, there are two 40- gallon drums on the boat which contain PCB-contaminated bu e water taken from the vessel's bull. Neither Hydro general mana- ger Tom MaLy nor commission chairman Bill Lawler were avail- able for comment. Durham Centre MPP Drum- mond White, who announced cabinet's decision, had no know- ledge of why an agreement bas not ben signed. «I personally haven't heard, the only thing. we can do at this point is wait, -said White. Although admitting he is not close to the discussions, White could not understand the delay. «I think we -as a governmnent have taken every step we could,» said White. The Town of Whitby and Hydro are to be «commen d" for their willingness to participate, said White. «I certainly hope Mr. Robinson and bis' lawyer are willing to follow through with the - agree- ment," he added. An exasperated Whitby Mayor. Bob Attersley could not shed any further ligit on the matter.. .ý «Ask thé province of Ontari they're looking after it,» said s"Sance 1 pecame a ev NataHlS woman, I've lout 43V. lbe., and 1,11 neyer gaindiem back!" Originally destined -foir'the Caibban as'a floating generat- ing station the ferry has been a sore p oint f'or the Town. .When the municipality tried to, force the issue a few years ago, it was thwarted in its efforts bythe federal government. Town officials were unaware that Robinson was paying dock- ingfeea to Ottawa. B ut last year, after the bar- bour was reclassified, the muni- cipality laid trespassing charges againat Robinson. I addition, the Town's solici- tor is seekinq a court injunction ordering Robinson to remove the vessel. If granted, Robinson would be subject to fines and/or imprison- ment if he failed to comply.'
