WHITBY FREE PRESS, WEDNESDAY, JANUARY 21, 1987 PAGE?7 Exce ptions, enfu rcement of vending bylaw ýd ebated, An Oshawa councilor says Durham Region's recently approved bylaw regulating yen- ding on regional roads should , include neWspaper boxes. "The biggest cuiprits are, the newspapers," said Ed Kolodzie at last week's regional* coundil meeting.. He bad also stated at a December meeting that newspaper býxes, located "on -key corners,"y were a problem as a potential *traffic bazard. In December regional coundil a p- proved tbe bylaw ta probibit ail vending on regional roads except where a permit is *issued. Applicants for permits pay a fée of $50 and assume ai l iabiity as well as responsibility for site maintenance. Permits are also issued for specifie locations, dates and times. 1The bylaw was passed ta, eliminate concession stands and' vending vehicles that posed traf- fic bazards on major roads. Farmers are ex- cludedl from the bylaw. Kolodzie argued tbat newspaper boxes were an exception to the bylaw. "lWe've got to have it one way or another, " he said last week. "lSomne of them are in awkward spots ... and they don't have to get permission from anybody." Uxbridge Mayor Gerri-Lynn O'Connor, agreed that the boxes are ýusually on road or street - corners and "bave adverse effects on driving." Regional chairman Gary Herrema said at the, December meeting that noý complaints had been made about newspaper boxes. he said the vending bylaw came as a resuit. of problenis witb vending vehicles in Uxbridge Township, at the inter- section of Highway 47 and Regional- Road 23, and on Brock Road in Pickering. Regional works com- mittee chairman Gerry Emmn said at last week's meeting that newspapers, willmove the boxes wben asked. Whitby councillor Tom Edwards suggested that the region consider a policy such as the one in Metro Toronto where newspapers, have to ap- ply for a location and paya fee. Other councillors had concerns about enfor- cernent of the new bylaW. Herrema and works commissiofler Bill Twelvetrees said Durham regional police sbould enforce te W=itby Mayor Bob At- bylaw enforcement of- ficers could enforce the bylaw. But Ajax Mayor Bill McLean said municipal officers can't enforce the bylaw unless given authorization. However, Attersley said municipalities can pass a peddler's and vendor's bylaw. He said Wbitby has such a bylaw and it bas been "lacted on," even on by. Oshawa councillor Brian Nicholson said the bylaw still had "Iserious flaws" Sirice it can't stop'people from selling, on their own property. he recommended that the region and the in-, dividual municipalities act jointly to corne up with a "clear bylaw."'I -Debate on the bylaw foilowed a recommen- dation by the- works on regipnal roads1 be circulated to the affec- ted local municipality to verlfy zoning complian- ce.' Council approved the recomniendation. Works commissioner Bill Twelvetress stated in bis report that may be appropriate- to even- tually give the licenc-ing procedure to area municipaities.
