WIITBY FREE PRESS, WEDNESDAY, OCTOBER 16, 1985, PAGE 9 Ministry issues desist order against local RV dealer - h Mi itr of Con- The Ministry of Con- sumer and Commercial Relations has issued a cease and desist order against North Brock Motor Sales, a Whitby company which sells trailers and mobile homes on consignment basis. The cease and desist order stems from the same ministry in- vestigation into North Brock Motor Sales' business practises which recentlv let to a total of 51 charges being laid against the com- pany, its owner, general manager, manager and four of its sales staff. Charges include defrauding the public, theft and fraud. The ac- cused are scheduled to appear in Whitby Provincial Court on Oct. 25. In exchange for 10 per cent commission, North Brock Motors sells mobile homes on con- signment. Based on evidence gathered by the Durham Regional Police Force involving 15 transactions over the past three years, it is alleged that the com- pany misrepresented the final selling price of trailers by telling owners that the trailers had sold for less than the actual price ob- tained and pocketing the difference. In doing so, North Brock Motors is alleged to have realized profits in excess of $31,000. Accurate reporting of sales prices to owners would have entitled the company to less than $9,000 in commission. In one other instance, the company represen- ted as new a year-old trailer which it sold to a customer. Total consumer loss from the transactions is estimated at $53,000. Facing charges are company owner Lorne Haight, 62, of Sun- N WHITBY derland; general manager Gordon Haight, 26, of Orono and manager Nancy Keith, 38, of Sunderland. Sales representatives Ronald Turcotte, 19, of Cannington; John Threader, 51, of Orono, Donald Haight, 28, of Sunderland and Nor- man Waller, 49, of Kingston have also been charged. The incident has caused the local branch oft me mnistr y %,i sumer and Commercial Relations to issue a warning to people selling on consignment. In addition to exercising extreme caution, the ministry advises that sellers ask for written contracts with com- missions and other costs clearly spelled out.
