Town Clerk Town of Whitby 575 Rossland Road East Whitby, Ontario L1N 2M8 Schedule 1 The following are copies of By-laws 1296-81 and 1297-81 THE CORPORATION OF THE TOWN OF WHITBY BY-LAW NUMBER 1296-81 BEING A BY-LAW TO AMEND BY-LAW NUMBER 1784 WHEREAS the Municipal Council of the Corporation of the Town of Whitby deems it advisable to amend By-law 1784. NOW THEREFORE, BE IT ENACTED, AND IT IS HEREBY ENACTED as a By- law of the Corporation. of the Town of Whitby by the Council thereof, as follows:- (1) That Section 2 of By-law No. 1784 is hereby amended by deleting subsection (zg) in its entirety and replacing it wlth the following: "PARKING SPACE" means an area of not less than 16.5 square metres, exclusive of any aisles or ingress and egress lanes, with a minimum perpendicular width of 2.75 metres and a minimum perpen- dicular length of 5.5 metres for the temporary parking or storage of motor vehicles and may include a private garage. (2) That Section 2of By-law No. 1784 is hereby anended by adding the following additional subsections: (ac) "APARTMENT DWELLING HOUSE" means the whole of a dwelling house that contains four or more.dwelling units which units have a common entrance from street level and are served by a common corridor and the occupants of which units have the right to use in common, the corridors, stairs, yards or one or more of them. An "Apartment Dwelling House" does not include a maisonette dwell- ing house or a quadraplex dwelling house, a group of row dwelling houses, or a pair or group of semi-detached duplex, or duplex dwell- Ing houses. (ad) "BANK" means a building or part of a building where money is de- posited, withdrawn or borrowed and shahl include a credit union, fi- nance or trust company. (bb) "CHURCH" means a building dedicated to religious worship and may include a church hall, church auditorium, Sunday School, con- vent, monastery or parish hall. (b) 'EATING ESTABLISHMENT" means a building~or part of a building where food is offered for sale or sold to the public for immediate consumption and includes such uses as a restaurant, cafe, cafe- teria, ice cream parlour, tea or lunch room, dairy bar, coffee shop, snack bar or refreshment room or stand; but does not include a boarding or lodging house. (nb) "GROSS FLOOR AREA" means the aggregate of the horizontal areas o<. each floor, whether any such floor is above or below grade, measured between the exterior faces of the exterior walls of the building or structure at the level of each floor, exclusive, however, of cI .. (zua) "UNDERTAKING ESTABLISHMENT" means any premises where preparation of the dead human body for interment or cremation is undertaken. (3) That Section 2 of By-law 1784 is hereby amended by deleting sub- section (d) in its entirety and replacing it with the following: "COMMUNITY CENTRE" means a building or part of a building ln which facilities are~provided for such purposes as meetings for civic, educational, poiltical,. or religlous, or social purposes and shall in- clude a banquet hall or private club.
