PAGE 10, WEDNESDAY, NOVEMBER 3,1976, WHITBY FREE PRESS THE CORPORATION OF THE TOWN OF WHITBY BY-LAW NUMBER 164 -,69 Being a By-law for the removal of snow and ice from the sidewalks and roofs of buildings in the Town of Whitby. 1. In this By-law, unless otherwise expressly stated, the word "Street" wherever used shall mean and include any public highway, road, street, lane, alley, square, place, thoroughfare or way within the limits of the Town of Whitby. 2. Every occupant, and in case there is no occupant, the owner, of every house, shop, building, lot or parcel of land, and every person having charge or care of any Church, Chapel or other public building or any park, square, or other property, fronting or abutting on any street on which the sidewalks are planked or paved or of other constructions, shall, within the first twelve hours after every fall of snow, or fall of hail or rain which shall freeze on the sidewalk, or after a fall of snow from off any building, cause the snow and ice to be removed entirely off the sidewalks opposite such house, shop, church, chapel, building, lot, park, square, property or parcel of land and in case the ice or snow shall be so frozen that it cannot be removed without injury to the sidewalk or pavement, such person shall strew the same with ashes, sand or some like suitable substance. 3. In case the snow and ice referred to in Section 2 shall not have been removed from the sidewalk opposite any land or premises within the 12 hour period mentioned in the said section, or in case any part of the surface of any such sidewalk has become slippery and has not been sprinkled at the time and in the manner prescribed in the said section, the Town Engineer or some other person appointed for the purpose may, at the expense of the owner of such land or premises, cause such snow and ice to be removed or such slippery surface to be sprinkled as and in the manneraforesaid and in every case the said Town Engineer shall keep an account of all costs and expenses of and relating to such work and materials and of the land or premises opposite to which such work has been done; and such expense shall be charged to the respective land or premises and shall be payable by the owner thereof and shall be added to and form part of the municipal taxes to be imposed on the said land or premises for the year following that in which the work is done and the Corporation shall have the same rights, powers and remedies against and in respect of the said owner and the said land and premises as though said expense was taxes levied under the provisions of Thp Municipal Act. 4. Every occupant, and in case there is no occupant, the owner of every house, shop or building, and every person or trustee severally or collectively having the charge or care of any Church, Chapel or other public building fronting or abutting on, or erected so near to any street that snow or ice may or is likely to fall upon the street from such house, shop, building, shall whenever snow or ice shall accumulate, upon any portion of such house or building as aforesaid to an extent that shall be dangerous to persons passing upon the street, cause the said snow or ice to be f orthwith renioved therefrom, and every person, while removing the same, and the person or persons responsible for such removal, shall take due sufficient and proper care and precaution for the warning and safety of the public using such street. 5. No person either by himself, his agents, servants or workmen shall remove snow or ice from any private property and place it upon the road allowance for any street, lane or highway in the Town of Whitby. 6. Any person convicted of a breach of any of the provisions of this By-law shall forfeit and pay at the discretion of the convicting magistrate a penalty not exceeding (exclusive of costs) the sum of $50.00 for each offence, and the provisions of Section 508 (2) of the Municipal Act shall apply ta the said penalty. 7. -By-law Na. 1409, 1607 and any other By-law inconsistant with the provisions of this By-law be and are hereby repealed. This commission was founded in 1939 by Dr. Joseph Calleja. Its aim is to assist Maltese abroad with any problems they may en- counter while living in a new chosen land. The majority of problems are related to family matters and other factors related to an environmental change. The Prior, Knight . Com- mander Grand Cross Joe Frendo-Cumbo, will delegate some of the workload to ,a number of his knights in the Sovereign Order of St. John of Jerusalem Knights of Malta, who reside throughout Ontario. He also has been commissioned to sit on the advisory council of the Social and Counselling Services -Commission. Joe Bugelli was master Qf ceremonies for the event, sponsored by the Malta Social Club of the Durham Region. Special guests included John Pisani, the Maltese Trade Commissioner for Canada. Whitby Mayor Jim Gartshore and Councillor Joy Thompson. Music was provided by The Imperials. The club's dance group, composed of Doris Woodward Doris Favarone, Betty Sacchett, Janie Vella, Terry Borg, Vivian Borg, Martese Bonello, Esther Pulis, Mary Anne Grinti, Cecile De Giovanni, Frank Borg, Fred Borg, Charles Favarrone, Mario Favarrone, Charles Bonello, John Pulis, Joe Vella, Paul De Giovanni and Charles Galea, performed three Maltese National folk dances.
