The thief sued for damages and won. Could this possibly happen Canada? A. Quite likely the same resuit would occur in Canada. An owncr- or occupier of land has a certain duty of care to everyone who cornes on it. The duty depends on whether the person cornes on as an invitee, a licencee, or a trespasser. A landowner may be liable in negligence if he sets hidden traps for a trespasser. Probably a trap gun set to catch a thief, with no warning sign posted, would be actionable if the thief were injured. m IjI~~ ~!You mighit also note that under s. 231 (1) of the CriminalCode, it is an indictable offence to set a trap or device likely to cause death or bodily harm "to persons, whether ascertained or not".
