The Expropriations Act R.S.O. 1970 Chapter 154 Notice of Application For Approval to Expropriate Land IN THE MATTER of an application by the Corporation of the Town of Whitby for approval to expropriate certain easements in the Town of Whitby for the purpose of the construction and maintenance of a storm sewer and appurtenances from the easterly limit of Garrard Road in Lot 18, Concession 2, to the centre line of the Goodman Creek, all in the Town of Whitby, Regional Municipality of Durham, (formerly in the County of Ontario). NOTICE IS HEREBY given that application has been made for approval to expropriate: 1. A permanent easement for the construction and main- tenance of a storm sewer and appurtenances over the lands described in Part One of Schedule "A" hereto annexed. 2. A temporary construction easement over the lands des- - cribed in Part Two of Schedule "A" hereto annexod wrth the right to enter upon said lands and to use dnd occupy said lands for and during the construction of a storm sewer and appurtenances. The said lands are to remain undisturbed by any work which might interfere with such construction, and clear of and unencumbered by buildings or structures other than those erected at at the date of acquisition of the easement. Upon completion of the construction of the storm sewer and appurtenances, the surface of the property will be res- tored as nearly as reasonably posible to its previuus condition~ and the temporary easement will be extinguished or expire and the lands will revert back to the owners. Any owner of lands in respect of which notice is given who desires an inquiry into whether the taking of such easements is fair, sound and reasonably necessary in the achievement of the objectives of the Expropriating Authority shall so notify the approving authority in writing. (a) In the case of a registered owner, served personally or by registered mail within thirty days after he is served with the notice, or, when he is served by publication, within thirty days after the first publication ofthfs notice; (b) In the case of an owner who is not a registered owner, within thirty days after the first publication of the notice. The Whitby Free Press columnist received his award during a civic brunch on Sunday at the Royal York Hotel. The Latvian-born journalist won this major newspaper award for a picture he took last December in Toronto. The award-winning photo shows Toronto firemen bat- tling a three-alarm blaze on Mutual Street which left two people dead. Kalnins' picture was judged against entries from the To- ronto Star, The Globe and Mail and the Toronto Sun. One of the better-known judges was CFRB news direct- or Arthur Cole,'who formerly was City Editor of the Tor- opto Telegram. After receiving his award, Alex remarked:"It was indeed a pleasant surprise. "Owner" and ."Registered Owner" are defined in the Act as follows: "Owner" includes a mortgagee, tenant, execution cred- itor, a person entitled to a limited estate or interest in land, a committee of the estate of a mentally Incom- petant person or of a person incapable of managing his affairs, and a guardian, executor, adminittator or trustee in whom land is vested; "Registered Owner" means an owner of land whose interest in the land is defined and whose name is specified in an instrument in the proper registry, land titles or Sheriff's Office, and includes a person shown as a tenant of land on the last revised assessment roll; 3. The Expropriating Authority, each owner who notifies the Approving Authority that he desires a hearing in respect of the lands intended to be expropriated and any owner added as a party by the Inquiry Officer are parties to the inquiry.
