Scott's report stated the officers fired their weapons a total of 11 times. The report does not say how many bullets hit Newman. However, it does say that one bullet struck him in the head, killing him. "They could reasonably conclude that he represented an imminent threat of death or grievous bodily harm to the first subject officer due to Mr. Newman's apparently purposeful approach to that officer while brandishing a knife at him, and his noncompliance with police demands," said Scott. "Further, that officer had no reasonable opportunity to escape the attack." The SIU is an arm's length agency that investigates reports involving police where there has been death, serious injury or allegations of sexual assault.
