Report From Queens Park i J A by Julian Reed Halton- Burllngton One major piece of legislation passed by the first session of the Legislature was The Residential Premises Rent Review Act This Act Is retroactive to 33th July 1875 to the extent necessary to full force and to Its provisions on from and after that date and to be repealed on the 1st August 1977 The majority of landlords and tenants in Ontario come under this legislation which covers all apartments houses townhouses duplets end triplexes rooming houses mobilehome sites and rent geared toincome units Under the terms of the Act a tenancy agreement gives or renews the right of a tenant to occupy a dwelling and such an agreement can be written verbal or Implied This means that even without a written lease people are covered by legislation In the case of a written agreement the Important date la that on which such an agreement comes Into effect rather than the date on which the document is signed The rent review legislation Is tied to the dwelling on an annual bail with the July rent taken as the base rent A tenancy agreement entered Into or renewed and becoming effective between July 30 and December must reflect a maximum rent In crease not exceeding eight per cent of the rent charged during the last full month prior to August 1 1975 unless tenant and landlord have agreed on a hlghr rate or the landlord has obtained the necessary ap proval from a rent review officer If a landlord applies to a rent review officer for permission to Increase rent by more than per cent a tenant may file application with the landlord requiring of the increase These applications must be made by January 1976 If the proposed excessive increase Is mutually agreeable to tenant and landlord then the rental Increase agreement must be signed no later than the January both parties retaining copies Tenants have an additional 30 days after signature of such an agreement In which to reconsider and file application with the rent review offices The agreement is only ef fective for the rental payment period ending 31 December Either landlord or tenant can dispute the increase by filing an application or giving notice no later than January If they do not agree on a rent Increase above the 8 per cent guideline or do not apply to have the rent for that period reviewed the tenant li entitled to a rebate of any rent paid in excess of per cent by February 16 1976 and If the landlord fails to make this rebate the tenant may apply to a rent review officer for an order requiring payment If a tenancy agreement la effective or renewed between January 1 and July 31 1976 Inclusive the per cent In crease limit must be observed but landlord or tenant can request a review A landlord seeking an increase of mora than per cent must file ap plication with the rent review office and Inform the tenant of his Intention at least days before the Increase It scheduled to go Into effect Until such time as a review officer makes a
