8533440 Acton man convicted another acquitted deer poaching case One Acton man was convicted while another local resident was acquitted of charges in con nection with a deer poaching incident last fall Fred Newell of Churchill ltd Sooth pleaded gutty and was convicted of unlawful possession of game and fined in Milton Pro vincial Court Thursday David DeForest RR4 Acton was found not guilty of possession of game A third man involved in the case Larry New ell of Milton pleaded guilty to unlawful of game and unlawfully transporting deer during a closed season He was found guilty on both charges and fined Charges of hunting out of season were dropped against both Fred and Larry Newell Ministry of Natural Resources officers laid the charges last September after discovering re mains of a fawn in a car trunk belonging to Larry Newell and deer meat in the home of Fred Newell A similar quantity of fresh deer meat was also discovered In the basement of Deforest res idence According to the testimony of the two brothers they were driving on the of north near at approximately 30 a September when they heard a gun shot They stated an alleged black truck took off when they approached the area of the gunshot Fred Newell said he got out of the truck hop ped over a fence and walked into a field where he almost tripped over the carcass of a deer He said the pair to another location where they proceeded to skin the animal and then returned to Fred Newell home w here they packaged the meat The two brothers then paid a visit to the home of Deforest and invited him to go for a The trio returned to Sideroad where the first deer had been found because the two brothers were curious the court was told They denied knowledge of a second fawn shot dead in the same location but admitted they taken the animal if they had found it Deforest said he had no knowledge of the deer nor did he realize the two brothers had left the meat in his basement until ministry officers located It during a search of his house The brothers stated they decided to leave the meat in Deforest s home while they went out for a ride with Deforest and did not feel it was important to Inform him of the meat Both men admitted they are hunters but said hey did not shoot the two fawn Several rifles belonging to the brothers were seized during a search of their residences but have since been returned sion is also dead now only had an option to buy land south of Highway and east or Churchill and the owners of the property also applied for develop ment though for houses not a plaza Their request to be allowed to develop the property was turned down pending the study to see if Acton had sewage capacity to grow The owners referred their re quest to the The urban boundary study for Acton unveiled in December and approved earlier this year showed there was capacity for growth here and identified the land south of Highway 7 and cast of Churchill as suitable for homes though a plaza was ruled out The region and town are in the process of in torpor the enlarged urban service boundary which will permit housing development east of town in the Official Plans The two referrals to the from the owners of property wont likely be with drawn until are completed During his long battle with the municipality Sprackman filed objections to several other pro jects in Acton Including a rezoning on Main St North for industrial land and a rezoning for the plaza on the Dominion Hotel site holding up ap provals for these projects until he finally withdrew his objections Many residents wanted a plaza built here and signed petitions supporting plan which included a supermarket but repeated ly the municipality said development should take place downtown first and didnt want so much land on the east side of town zoned for commercial wanted much more land than his plaza would have covered His decision to withdraw his appeal ends a long controversial issue in town and a battle for the
