The Corporation Of The Town Of Milton BYLAW NOT 6074 EXPLANATORY NOTE The original Zoning Bylaw No or the former Township of passed on April 3 Since then Township Council has am ended In many Instances certain portions of the Bylaw It would now appear after mak ing a consolidation of all of the amending Bylaws that certain Interpretation problems and Implementation problems have been created as a result of the amendments affecting the ori ginal Bylaw The problems being experienced result In corf difficulty administering the Zoning Bytaw tor the former Township of and thereby Milton Council are at this time proposing an amendment In the form of the attached By law No Bylaw has been passed by Milton Council tor the sole purpose of the problems arising out of the administration of Zoning Bylaw as it Is amended to date The original Zoning Bylaw tor the Township of Nassagaweya contemplated three types of residential uses within the Rural A designated area- A a ft residence on a acre land severance B a 1000 ft residence on a ft land severance C a 1000 sq ft dwelling unit as an accessory use to the principal uses of the land This dwelling unit would be erected on the same lot as the principal use Over the interim amendments were processed making to the regulatory provisions within the original Bylaw A consolidation of these changes now Indicates that with the exception of an accessory dwelling unit to a permitted prin cipal land use residential uses have been completely removed from the Rural A section the Zoning By law Even though the original Bylaw No It did end still contains a provision whereby lots created prior to the passing of the By law may have a dwelling unit constructed thereon there Is no thing contained In the present Bylaw that would permit a resi dential use other than an accessory dwelling unit on parcels that had been created since the passing of the Bylaw It was therefore necessary to pass Bylaw providing for these parcels of land that have been created during the Interim be tween the passing of the original Bylaw and the present time Section of the Bylaw deals solely with the renumber ing of sections In the Bylaw In order to make them conform to the proposed amendment Section of Bylaw simply deletes a sentence from a certain section In order to add to the clarity of the Bylaw The sentence Is reinserted In another location In the Bylaw thereby making the Bylaw read more clearly Section Bylaw clarifies the provisions and regula tions affecting the construction an accessory dwelling unit on the same parcel as the principal land use to which It Is ac cessory Section Sot Bylaw Inserts a provision for a ft residence on a acre parcel within the Rural A designated area The section also inserts a provision for a 1000 sq ft NATURE LOVERS residence on a parcel of land containing less than acres within the Rural A designated area Those two provisions aro similar to those contained in the original By law No 1147 Hinton plot trade review Another attempt by Bert Hinton of Acton to exchange burial plots he owns In Cemetery for other town owned plots was blocked Wednesday night after a Ions confused debate when Mr withdrew the request temporarily Mr claimed his request now complied with the bylaw but Councillor Harry Levy stated ho was quoting from the wrong bylaw We now have a new bylaw covering all of Hal ton Hills said Levy Mr said he was now asking for plots In rotation along the rows aa was demanded by the new bylaw He agreed to pay the extra for the registration of deeds Councillor Joe Hurst said he supported the request because he felt It could benefit the town He sold the plots owned by Mr could be added to a Vshaped piece of municipal land to make an attractive land scaped area at the entrance to the cemetery He Bald the plots would be In sequence as the bylaw demanded Councillor Harry Levy stated This matter been twice to the finance com mittee and twice terpretation of the consolidated amendments to the original Bylaw The amendment Is not Intended to Impose more restrictive regulations than existed within the By law when It was passed in the first Instance The Bylaw does however al low for the development of properties that were created during Interim from the passing of the original Bylaw to the pre sent time and thereby eliminate the hardship which appears to have been created affecting those owners The Intent of the By law is for clarification purposes and does not directly rone property To the foregoing this amendment will now permit the Issue of building permits for lots created between the date originally passing the Bylaw and May 31 without necessitating a rezonlng Any further Information required in connection with this By law can any llons or complaints from the Municipal Board and that he expects It will soon be op- proved AH we have to do Is any there will lot change reviews until after the bylaw comes into effect Levy ad ded The committee told that they would consider a trade of lots but that hey would sell him seven double lots the current price of and then subtract the 250 he originally paid for lots in 1968 We dont want another Georgetown cemetery situa tion where have grave openings Councillor Miller said To avoid openings and to prevent setting trading precedents which would contravene Ihe bylaw the committee refused to recom mend that Mr be al lowed to change rows and that the only change that he be allowed to make would be to move further down his pre sent row If we dont say no this time we will never by
