responsibility in an accident in cases where a mechanical failure has been proved to be the cause in dismissing a damage action against fred sykes harvie ave toronto mr justice barlow said an automobile driver is only re quired to use reasonable care and skill and cannot be expected to be an insurer of his vehicles mechanical perfection at all times the action was brought as the result of an accident in toronto in 1918 in which sykes car was involved with one driven by mr archibald morton morton and his wife were both injured in the collision the cable to the hydraulic brakes in sykes
