house had been placed on the reg- ister because it had potential cul- tural heritage value as an example of Arts and Crafts architecture. She also said its age could not be confirmed. Placement on the Heritage Register means a demolition restriction is placed on the proper- ty whereby the owner of the prop- erty is required to give the munic- ipality 60 days notice to demolish or remove a building or structure from the property. The 60-day waiting period allows the municipality to consider saving the property by designating it under the Ontario Heritage Act In the case of 152 Caulder Dr., however, the Towns Director of Planning Services Dana Anderson said the protection of the Heritage Register did not apply. The property had a signed dem- olition permit prior to the listing of that home on the Heritage Register so they (the owners) are well within their rights to act upon that demolition permit and unfortunately there is nothing we can do at the Town to stop that, she said. Its unfortunate, but based on the time of the demolition permit, thats the process and the Town doesnt have any authority to revoke that. A report to the Heritage Committee of Oakville, dated July 17, 2009, stated there was a possi- bility for council, in consultation with Heritage Oakville, to file a Notice of Intention to Designate (under the Ontario Heritage Act) the 152 Caulder Dr. property, and other properties for which demo- lition permits had been issued prior to them being placed on the Heritage Register. The report said that once a notice had been filed, demolition would not be allowed. Anderson stated the Heritage Oakville committee never proceed- ed with the designation of the prop- erty. When reached for comment Oakville Heritage committee chair and former mayor Harry Barrett said the time simply does not exist to designate all the properties the committee would like. You have to do considerable research on each house, each prop- erty to designate it, he said. Theres only so many hours in the day to do this. We would like to designate a lot more than we do, but were limited, right now we are down to two people (heritage plan- ners) and thats the reason some of these houses are on the Heritage Register, but have not been desig- nated. Barrett said he is unhappy to see any building torn down and called for more people and resources to be put towards the Towns Heritage Planning Department to accelerate the process of research and designa- tion. Ward 5 Councillor Jeff Knoll, who witnessed the demolition, talked about how the situation could have been better handled. What I was disturbed by was that the heritage resources that existed on the site that could have been transplanted for little or no money were basically being bull- dozed along with the house, said Knoll. It just seemed like such a waste and it happened so quickly and without consultation from the local historical groups.
