That on May 20th the plain- tiff camo alon^' and would not take them, as he claimed they had not got fat enough fur shipping and a new bargain was made to hold them over till the middle of June. O'Brien then tiiok up the rest of his cattle and went with them to England and stayed to see the Coronation. That Ftan- ci.ses fed the cattle until July 9th, when, not being able to get any word from O'Brien, and not beinjj able on a personal vi.sit to his house to get any postive state- ment from his people .is to when he would be back, they sold the cattle to Kus.soU & Mclntyre, reserving O'Brien's rights till July 14th, for the same price as O'Brien should Iiavo given, and Russell & Molntyre sold them next day in Tor- onto at Ktiil the .same price, the market nTjt beintr at that date very good. Soon after this O'Brien returned, getting to b'raneis place on July 17th, and asking for the cattle. ' Then he sued them as above the loss of profits on the herd. The trial lasted all day, and a good deal of evidence as to the feed, markets at the dates, etc., was given by experts.
