Dictating where things can and cannot be built has proven unpopular with a number of developers with appeals filed by Mattamy Realty Limited, Oakville Developments Inc., Emshih Developments Inc., and Silgold Developments Inc. "It goes back to the secondary plan with all the positive and great things that were worked out through that settlement," said Jessica Junker, Mattamy spokesperson. "We believe the existing regulations and requirements were put in place for great development. We live and work in Oakville, so we are fully committed to seeing north Oakville proceed in a very positive way. We just want to make sure the roads and the infrastructure are compatible and complimentary as the development unfolds in north Oakville." Developers, however, are not the only appellants with Maple Grove United Church and Halton Presbytery of the United Church of It's been lauded as the Official Plan to create the most livable community in Canada, however, not everyone agrees with the Town's vision of livable. According to a Town staff report released last month, there are currently 47 appeals filed with the Ontario Municipal Board (OMB) against the Town of Oakville's new Official Plan. This number of appeals originally sat at 56, but the OMB administratively closed two of these while seven other appellants withdrew. Passed unanimously by Town Council on June 22, 2009 and approved by the Region of Halton on Nov. 30, 2009, the Official Plan essentially provides the blueprints and rules that will guide local development until 2031. Known as Livable Oakville, the plan outlines policies for growth centres such as the Midtown Core, Uptown Core and the Kerr and Bronte villages. Brian Simpson, of Maple Grove United Church, said the church has land available at the rear of its property on which it wants to build a Life-Lease independent seniors' residence, but is prevented from expanding its facility due to policies within the new Official Plan. "Oakville says it's the most livable community in Ontario, but it's not very livable when you have a community of around 30,000 (east Oakville) people without a centrally located seniors' residence," said Simpson. Reverend Dr. Morar Murray Hayes, of the Interfaith Council of Halton, also spoke about the status of places of worship under Livable Oakville. She expressed concern the new rules would give places of worship greater than two hectares in size an institutional designation, which would restrict where they could be built. Murray Hayes also said the plan limits the ways a place of worship's land can be used and limits the way a place of worship's land can be disposed of. "In many areas in Oakville, it is the worshiping communities that provide the community centre for activities that have no other space to meet in, activities that can't afford to pay rent and community groups that are universally recognized as being beneficial like the scouting movement, the guiding movement the 12-step program," said Murray Hayes. "Under the already existing plan there are many limitations and we are treated like developers. Whenever there is any renovation or upgrading of the building, there is a process we have to go through and it is onerous and very costly, and unlike developers we can't recoup anything because we are not doing this for a profit making venture." Oak-Land Ford Lincoln owner Len Sanci also voiced concerns about what the new Official Plan would do to his business. "I've been here at the same address for over 40 years and I like it here (at 570 Trafalgar Rd.) and I want to stay here, but the new Town plan prohibits new car dealerships in the Midtown core," said Sanci. "I would be legal non-conforming and I don't really want to be legal non-conforming I like it just the way it is. The designation they are going to give this land is civicuse designation. Do you know anyone in the world that could buy a property that is civic use? That's why we put in the appeal because I don't know what that will do to me and I'm not particularly happy to leave my future up in the air like that."
