Existing drive-thrus, which find themselves in prohibited areas, will be allowed to remain in place, receiving a legal nonconforming designation. Members of Oakville's business community made a number of delegations to council on Monday attempting to convince councillors to defer a decision on the issue until additional study had been done. Representatives from the Oakville Chamber of Commerce, McDonald's Restaurants, Tim Hortons, the Ontario Restaurant Hotel & Motel Association (ORHMA) and others said the restrictions Restrictions aimed at satisfying residents' concerns would negatively impact future businesses as drive-thrus are popular among customers. Others argued the restrictions amounted to an outright ban of new drive-thrus in Oakville as the restrictions prevent the building of drive-thrus in any part of Oakville a business would want to locate. Town staff disputed this. Others argued the restrictions were not fair to people with mobility issues while still others argued there would be no air quality improvement if the restrictions were put in place as more people would just use the existing drive-thrus. Ward 5 Councillor Jeff Knoll, who voted against the restrictions, voiced concerns about what the legal non-conforming designation would do to existing drive-thrus. "We've heard from the delegates, and I think even from just common sense it's clear that when you put a business into a legal non-conforming position you are potentially impacting that business' ability to achieve financing, their ability to achieve insurance, even contractual law could be impacted," said Knoll. "I looked at the lease I have on my business (Encore Cinemas) because I was curious and one of the things I signed in my lease was that I would be in absolute compliance with all aspects of municipal law. I suspect (agreements like this) might be another thing that we have to take into account here." Knoll said the business community was only asking for the issue to be examined for another month and wondered what harm it would do to defer. Councillors (Ward 2) Cathy Duddeck and (Ward 1) Ralph Robinson said extensive public consultation on this issue, including six public meetings, had been held with the item having already been deferred in the past. Town staff said nothing would be accomplished by deferring other than to give members of the business community an opportunity to present again. In his remarks Ward 4 Councillor Allan Elgar said he would have preferred a 30metre separation distance between drivethrus and residential areas. A number of residents, who presented on Monday said they would have preferred a 60 metre separation distance.
