Burton said that according to TransCanada's site plan submission, the nearest building on the site would only be 7.5 metres from the rail corridor. The Town's Committee of Adjustment rejected a request by TransCanada to reduce the setback from the rail lines from 15 metres to 7.5 metres in a ruling TransCanada is now appealing to the Ontario Municipal Board (OMB). TransCanada spokesperson Chris Breen disputes the assertion that TransCanada wants its buildings to be closer to the rail lines stating its buildings will be 15 metres away from the railway as required with only, what its calls its ancillary services (water tanks, part of the sewage system) approaching the 7.5 metre mark. He also pointed out that the tracks the ancillary services will be 7.5 metres away from are not the major CN and GO Transit rail corridor, but what are called `yard tracks,' which are used to park and prepare rail cars for dispatch. For this reason train speeds on these tracks are very slow. Breen said the next closest tracks are industrial spurs connected to Ford on which trains are not permitted to exceed 10 miles per hour. The main rail lines used by GO and CN are more than 30 metres from the TransCanada property line, said Breen. Breen also has doubts about a train derailment's ability to cause an industrial accident or the plume from the power plant's ability to cause a derailment, as has been suggested. "When considering safety, it is also important to remember that there will be no gas stored on our site. The pipelines that will transport natural gas are buried almost a metre underground. The pipeline connection points to our plant will be raised well above track level and surrounded by steel barriers set in concrete. North America's natural gas pipeline system is the continent's safest energy transportation system," said Breen. "The plume will not be a safety concern on the rail lines. Our Environmental Review Report includes studies, which assess the potential for plume impact. CN is welcomed to review this report and provide comments in any area." Oakville Mayor Rob Burton announced Thursday, April 1, that he has asked the Minister of Transport John Baird and the Chair of the Transportation Safety Board Wendy Tadros to investigate the potential safety issues of locating a major natural gas power plant next to a major freight and passenger rail corridor. "The derailment in Pickering reinforces my belief that power plants should not be built near sensitive land uses and clearly demonstrates that the Town of Oakville requires more time to undertake a comprehensive consultation to create guidelines that will protect the health and safety of the Oakville community," said Flynn.
