The case of Vickers v. Canadian Pacific Railway was commenced 1st of June at Osgoode hall before Chancellor Boyd, pursuant to special appointment. The action is one brought by the Vickers Express Company to compel the Canadian Pacific Railway to carry their express parcels over the Toronto, Grey & Bruce division of their road and the Teeswater branch for a fair compensation. The ground of the action is that the C.P.R. [had] refused to carry the plaintiffs' parcels on the ground that they had specially contracted with the Dominion express company to give them the exclusive right over that road. The plaintiff contended that under the railway act such a monopoly cannot be created but that all express companies must be treated alike ; they also claim $20,000 damages for loss through the railway's refusal. Five Queen's counsel are engaged in the case, which will probably take all day.
