Christmas Seal proâ€" By Terry Patterson It barely made a ripple in the media when it came into effect on January 1 this year but, as the years press on, Bill 164 is likely to have a significant impact on Ontario‘s auto insurance system. And your own, personal bottom line. The Bill gives us all the right to obtain bigger â€" and better â€" benefits if we‘re involved in a traffic accident. It gives back the right to sue an atâ€"fault driver for compensation for pain and suffering and it extends coverage to the "special needs" of accident victims suffering longâ€"term disabilities. Benefits are automatic, available to every person injured in a car accident (whether driver, passenger, cyclist or pedestrian), and they are indexed to the cost of living. The legislation replaces the Ontario Motorist Protection Plan and although the Government claims that it will stabilize the cost insurance, it‘s tough to see how. The Bill puts a tremendous cost burden on the existing system and somebody‘s going to Ihave to pick that up somewhere along the ine. * 90% of your indexed net income, up to a maximum of $1,000 a week selfâ€"employed people will now be eligible as well). The OMPP allowed up to $600 a week; * Supplementary medical and rehabilitation benefits of up to $1,000,000 (no time limit). The new legislation will also allow Ontario residents to purchase an optional Economic Loss Endorsement (an OEF45) that will provide up to $1 million in benefits to replace the contribution a deceased insured made to his or her family. There are specific instances in which this Endorsement is applicable and your insurance broker will have the details. Your insurance company must, by law, provide the benefits required by the government‘s new legislative changes immediately so you are covered even before your policy comes up for renewal. The exception is the optional Economic Loss Endorsement, which is available only if you request it. If there are any disputes relating to your policy, the Ontario Insurance Commission will mediate between you and the company.
