hope that very few and perhaps no bills of indictment for capital of fences will be preferred for your consideration at the present arizes and this i think we may justly attribute in a very so extraordinary in its nature as to call for a particular comment from tie court i will avail myself however of the present opportunity under such circumstances to make a few observations on the mans usually resorted to for preventing crimes in general i perceive several cases of larceny in the calen dar and 1 regret to observe that this offence v of rather frequent occurrence in many parts of the province the rapid increase of our population which brings together every description of persons may be on caue of the frequent repetition of the offence but whatever may be the origin oftheev it must be admitted it is the duty of alt classes find out and adopt the most efficient mea lessen it public punishment is the ordinary means resorted to ior this purpose and indeed its power ful effect to this end is universally allowed the penitentiary system adopted by our legisla tore in this province is very similar to the one in england and the united states of america and is well calculated for the projer punishment of larceny and other inferior crimes it is a desirable substitute for the old and more rigorous system and so long as the objects of its influence are safely confined within the bounds of the prison ihey will be unable to disturb society by evil practicesr or to corrupt its morals by theinfluence of vicious habits whe ther the penitentiary system wii answer the expec tations of the public either in the reformation of offenders or an example to deter others in yet problematical but it is quite certain that j to ires to reap human mature fa then pliant habits have noty4 lifts received a moral and religious education to el considerable extent to be ever led into it we would do well to imitate the noble example of scotland in her mode of diffusing education throughout the greiit mass of the popula tion there is perhaps not ampler provision for public education in any oiher of the world so early as the year 1697 an act was passed ordaining that there should be a school nn schoolmaster in every parish and in the year is03 the legislature most judiciously augmented ll salaries of the school masters and provided each tf them at the public expense withacommodious svlioolhouae and dwel ling house in these school are taught reading writing arithmetic geography and even latin and greek thereby placing gotfjj education within the reach of every one and the consequence has been that knowledge is generally sought after and igno rance is considered disgraceful cv in the most in digent this laudable spirit ts universally spread and it rtny i think be aswrtet thai a more moral or better instructed class of people u not to be found anywhere than the great body 0 the people ta scot land when we consider lh without instruction by means of permanent publi schools a large pro portion of the youth of the province will receive no education whatever the absolj necessity of the in terference of the legislature favor of a mure libe- ral extensive and better s throughout the country appears to me quite obvious- one great obstacle to a sufficiently expensive establishment seems to be the difficulty in obtaining an adequate number of well qualified teac f a t com mon schools which ought to formed but i am quite convinced if sufficient si wax given and proper accommodations proj fl masle there would be no real difficulty m thin rosmv- tiie other hand confusion ad crime are always found to increase when this important duty is not effectually attended to and encouraged by all ranks a celebrated writer la justly obsetved that design of criminal law is to usseu the number of crimes in future and thereby givo every man a sense of his personal security and if this could be done without the actual punishment of any one so much evil wouid be prevented as his punishment implies there is no effectual method of restrain ing vice of all kinds but by early and deeply incul cating the principles of integrity honor and religion on the minds of youth in a virtuous education af ter this they will hardly be seduced very soon and when sobriety and virtue are become habitual to them they will both find their greatest satisfaction in
