grant forsyth 24 died of pul monary oedema at the ux bridge hospital following an accident oil a countv road on april 22 the jurys verdict was that the deceased came to his death as the result of an accident on the 7th concession of scott township about 430 pm april 22 and that death was caused by pulmonary oedema they also found that the accident was caused by a combination of excessive speed misjudg- merit in passing a car driven by john maclean with prob ably some impairment because of alcohol in its recommendation the jury suggested that county roads should be more thor oughly covered with maximum spied signs and that the legis lature should consider having laws made that would make it possible to place protective speed signs in small villages which would be valid they also recommended that a concealed intersection sign be erected north of the intersec tion of the ieaskdale sideroad and the 7th concession of scott township andor the rise of ground should be cut down to give a longer view from the north to the leaskdale sideroad in collision during the hearing of evi dence which was adduced through crown attorney bruce affleck john neil maclean of toronto told the court that about 430 pm april 22 he had turned from the leaskdale side road to go south on the 7th concession and his car had been struck on the left rear fender by a ear from the rear which he had not observed prior to the accident maclean said that this car shot past him at a speed he estimated to he between 60 and 70 mph and struck the east curb of a bridge and toppled over on its roof into the creek driver conscious he said that the driver wai pinned beneath the wreck and was freed only by using a truck and chains from a garage near by maclean said that forsythe when freed said that he was allright and did not want to lie down on the garage creeper which was used as a stretcher to take him to the garage to await the ambulance william kennedy rr 2 ux bridge said that he had been parked at a store in leaskdale when he heard forsythes car hit macleans car and then go over the side of the bridge ho estimated its speed at 50 to co mph kennedy told the jury that 30 mph signs were posted at both entrances to leaskdale and that the accident occurred between those signs he also told the jury that forsythes convertible top was down and a canoe was on top of the car prior to the accident but was thrown clear by the impact charles lyons of leaskdale said that he had met forsythe about two miles north of leask dale just prior to the accident and estimated his speed at 60 to 70 he said that he never noticed any speed signs on the 7th concession signs no sanction opp constable john speirs of brechin said that although there are two 30 mph signs posted the speed limit through leaskdale is 50 mph because there is no legal sanction for the signs because the size of the community does not war rant a 30 mph zone pc speirs said that there was at least one 50 mph sign near uxbridge on the 7th concession and that the limit on the road posted or not is 50 mph crown attorney bruce affleck reported that samples of blood and urine had shown 65 and 95 parts per thousand
