his con science the coliseum in ottawa the the history of canada i home of the central canada i annual exhibition was the the scene last weak ws of many demonstrations thrilling to all canadians the six thousand who were there and the other millions both lib eral and conservative who watched the proceedings by the medium of television the pro ceedings of the three days con vention were a very real demon stration of democratic proced ure in action the ordinary man and woman from hamlets vill ages towns cities and provin ces from newfoundland to british columbia and from the southernmost tip of ontario to the northern reaches of the yu kon territory were gathered in ottawa to choose the new lead er their nouveau chef and they chose this man in the same free and democratic way that all our elections are held any one could have been a candidate no matter what his walk of life his religion or his promin ence so long as he or she was a canadian and in fact as you may have seen an unknown in politics a reverend mr hender son from portage laprairie was a candidate for the leader ship and he shared the same privileges as were given to the more prominent candidates for the leadership equally important to me with the free and democratic process of the election of the new leader mike pearson was the fact that the delegates chose not a poll tician but a statesman as their leader in these troubled days for canada and the world mike pearson is comparatively new to politics but he if old in ser vice to his country and to the world those of you who saw parades and speeches during the three days of the liberal con vention it was a colourful dis play many delegates identify ing their province by wearing the provincial symbolic flower others giving their province publicity by handing out apples british columbia packets of wheat saskatchewan and oth crs identifying themselves with headbands or badges and still others by staging parades or singing their local songs but the delegates while proud of their local area were canadians and sectional differences in thought policy race religion or language never appeared on the surface or below the sur face the gathering was that of united canadians there were speeches from wellknown canadians former federal cabinet members pro vincial premiers senators and there were speeches given by less prominent canadians young people interested citi zens and all were treated alike listened to and considered a real feature of the convention was the many tributes paid to retiring leader the rt hon louis st laurent the tributes were most moving and brought a tear to the eye of more than one delegate canadians of every province and of every party can be proud of this 4th national liberal leadership convention and of the choice of the new leader mike pearson for bridget and me it has been a voyage into history that will forever live in our memories worth label and morden c l dubin was appealing mr jus tice barlows refusal of an in junction against gravel pit oper ations by w h godfrey in a portion of the greenbelt their lordships reserved their de cision w b williston representing mr godfrey said the bylaw was beyond the powers of the coun cil setting up a greenbelt should be done under the planning act not the municipal act he claim ed mr dubin held that the 1955 bylaw was a valid exercise of councils powers under the mu nicipal act in the prescribed part of the township it set out that resi- dential land use as well as agri- j cultural institutional and recre ational land were to be permit ted under certain conditions but no use of land for com mercial and industrial purposes was to be permitted digging and loading gravel for sale was a commercial or industrial land use or perhaps both said mr his lordship said that as far as he knew in a democratic country no mans property had been taken away without com pensation in a democratic country we havent the free right to use land as we wish mr dubin re plied mr justice aylesworth said that if mr godfrey had put up a building or installed screening equipment on the land involved then definitely he would be en gaging in business but merely digging and carting away gravel was something else the intention to develop the land as a gravel pit was estab lished mr dubin contended ac tivities above the surface of the ground indicated the land use mr justic aylesworth won dered if perhaps the issue did not rest on whether mr god frey was using his land or using it up digging in the land and re moving gravel for sale desig nates the use of the land said mr dubin mr justice lebel commented dubin that removing part of the land mr williston conceded that a was the sarae as land use mining operation had taken n oil seeped up through a gar-
